Legal Agreement and Binding Nature

These Terms and Conditions constitute a legally binding agreement between you and ML Pipeline. By accessing, browsing, or using our website and services, you acknowledge that you have read, understood, and agree to be bound by these terms in their entirety. If you do not agree with any provision of these terms, you must immediately discontinue use of our services.

This agreement establishes your legal obligations and responsibilities as a user of our machine learning engineering services. We reserve the right to update or modify these terms at any time without prior notice. Your continued use of our services following any changes indicates your acceptance of the modified terms. It is your responsibility to review these terms periodically for updates.

User Obligations and Legal Responsibilities

1. Legal Compliance Requirements

You agree to comply with all applicable international, national, state, and local laws and regulations in connection with your use of our services. This includes, but is not limited to, compliance with data protection laws, intellectual property laws, export control regulations, and any industry-specific regulations that may apply to your use case. 9. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We make no guarantees regarding the accuracy, reliability, or completeness of any content or information provided through our services.

10. Limitation of Liability

To the maximum extent permitted by law, ML Pipeline shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use or inability to use our services. Our total liability to you for any claims arising from your use of our services shall not exceed the amount you paid to us in the twelve months preceding the claim, or one hundred Japanese Yen, whichever is greater.

11. Consequential Damages Exclusion

Under no circumstances shall ML Pipeline be liable for any loss of revenue, loss of actual or anticipated profits, loss of contracts, loss of use of money, loss of anticipated savings, loss of business, loss of opportunity, loss of goodwill, loss of reputation, loss of damage to or corruption of data, or any indirect or consequential loss or damage, whether arising from tort, breach of contract, or otherwise.

12. Force Majeure Provisions

We shall not be liable for any failure or delay in performing our obligations under these terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials. Our obligations will be suspended during the period such force majeure circumstances persist.

Legal Information and Dispute Resolution

13. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any disputes arising from or relating to these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Tokyo, Japan. By using our services, you consent to the personal jurisdiction of these courts and waive any objection to venue in such courts.

14. Dispute Resolution Procedures

In the event of any dispute, controversy, or claim arising out of or relating to these terms, the parties agree to first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiation within thirty days, either party may submit the dispute to mediation. If mediation is unsuccessful, the dispute may be submitted to binding arbitration or litigation in accordance with the governing law provisions above.

15. Severability Clause

If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severable from these terms and shall not affect the validity and enforceability of the remaining provisions. The remaining provisions shall continue in full force and effect, and the invalid provision shall be replaced with a valid provision that most closely matches the intent of the original provision.

16. Terms Modification Policy

We reserve the right to modify these Terms and Conditions at any time. All changes will be effective immediately upon posting to our website with an updated "Last updated" date. Material changes will be communicated through prominent notice on our website or via email if you have provided contact information. Your continued use of our services after the effective date of any changes constitutes your acceptance of the revised terms. If you do not agree with the modified terms, you must discontinue use of our services.
